The situation of women in Afghanistan in the years 1996-2025 from the perspective of the dynamics of social, political and legal transformations

Abstract

The subject of this dissertation is an analysis of the situation of women in Afghanistan between 1996 and 2025 in the context of social, political, and legal transformations, with particular emphasis on the role of formal and informal institutions in shaping the possibilities for the realization of women’s rights. The starting point for the study is the assumption that the scope of women’s rights and the actual opportunities to exercise them constitute an important indicator of the functioning of socio-political systems, particularly in states experiencing prolonged political instability and conflict. The research problem focuses on the situation of women in Afghanistan from 1996 to 2025 within its social, political, and legal dimensions, with special attention paid to the role of institutions in shaping opportunities for the realization of women’s rights. The adopted time frame encompasses three distinct phases in the functioning of the Afghan state: the first Taliban regime (1996–2001), the period of political transformation and the presence of the international community (2001–2021), and the period following the Taliban’s return to power in August 2021. This approach enabled a comparative analysis covering both periods of the expansion of women’s rights and periods characterized by their systematic restriction.
